The Supreme Court of Pakistan (SC) has declared that publishing an ordinance without a state of emergency violates the country’s constitution.
The Supreme Court delivered a written verdict on the ordinance, and Justice Qazi Faiz Issa authored a 30-page decision.
The Supreme Court emphasised in its judgement that every word of the constitution must be obeyed to the letter. The method for issuing the ordinance is outlined in the constitution.
According to the ruling, the president and governors are unable to carry out the proclamation unless certain constitutional prerequisites are satisfied. The ordinances are only in place for a limited time. The ordinance should be utilised to avoid the acquisition of long-term rights and responsibilities. People’s rights must be preserved through the legislative process.
